Brief Blog: May 12, 2010 – Kagan’s sexuality not an issue

Did the Wall Street Journal include a three-and-a half decades old photo of SCOTUS nominee Elena Kagan playing softball in today’s feature story to imply that Kagan is gay? Do WSJ readers care? I sincerely doubt it.

Personally, I have no interest in Elena Kagan’s sexual proclivities.  What I want to know is whether or not she is qualified for a lifetime appointment to the highest court in the land. And I suspect that is the concern of most thinking Americans.

This is the first time in memory I’ve agreed with retired Brandeis professor and North Scottsdale resident Linda Hirshman. Hirshman writes in The Daily Beast, “There is nothing wrong with being gay (or lesbian). What hurts is the assumption that it hurts …..Treat same-sex orientation as a liability, and, guess what, it becomes a liability.” She’s correct.

Kagan’s gay (or not). Let’s move on.
